These Terms & Conditions (the “Terms”) govern your use of the Flourish website and any purchase you make through it (together, the “Site”). The Site is operated by Flourish

By accessing the Site, creating an account, or placing an order (including as a guest), you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Site.

These Terms should be read together with our Privacy Policy, which explains how we handle your personal information.

You may use the Site for lawful, personal, non-commercial purposes such as browsing products, creating an account, and placing orders. You agree not to:

• use the Site in any way that breaks the law or infringes the rights of others;
• attempt to gain unauthorised access to the Site, other accounts, or our systems;
• copy, scrape, or use automated tools to collect data from the Site without our written permission;
• interfere with or disrupt the Site, or upload malicious code or harmful content;
• resell, or attempt to resell, products bought from the Site without our prior written consent.

We may suspend, restrict, or withdraw access to all or part of the Site if we reasonably believe you have breached these Terms.

You can create an account to check out faster and view your order history, or you can check out as a guest without creating an account (see Orders and Payments below).

• You are responsible for keeping your login details confidential and for all activity that happens under your account.
• You agree to provide accurate, current information and to keep it up to date.
• Please contact us promptly if you believe your account has been used without your permission.
• We may suspend or close an account if these Terms are breached, if information provided is inaccurate, or if we suspect fraud or misuse.

You can ask us to close your account at any time. Our handling of your data after closure is described in our Privacy Policy.

We sell wellness and nutrition-related products. We take care to describe and picture products accurately, including details such as descriptions, ingredients, and nutrition information where provided.

• Packaging, formulations, and ingredients may change from time to time. Always read the label and information supplied with the product you actually receive before use.
• Product information is provided for general information only and is not medical or professional health advice. If you are pregnant, nursing, taking medication, or have a health condition, please consult a qualified healthcare professional before using a product.
• Colours and images may appear differently depending on your device and screen settings.

If a product you receive is not as described, please contact us so we can put it right under the Returns, Refunds, and Cancellations section.

When you place an order, you are making an offer to buy the selected products. Any order confirmation we send is an acknowledgement that we have received your order — it is not acceptance of it. A contract is formed only when we confirm that your order has been accepted or dispatched.

We may decline or cancel an order (before or after confirmation) for reasons including product unavailability, a pricing or description error, a problem with payment, suspected fraud, or because we cannot deliver to your location. If we cancel an order you have already paid for, we will refund the amount paid for the cancelled items.

Payments

• Payments are processed by a third-party payment provider PayMaya. Your payment details are handled on their systems; we do not receive or store your full card number.
• You confirm that you are authorised to use the payment method you provide.

Guest checkout

If you check out as a guest, you provide contact, delivery, and payment details for that order only, without creating an account. You are still responsible for making sure the information you give us is accurate so we can fulfil and deliver your order and contact you about it.

• Prices are shown on the Site in [currency, e.g. Philippine Peso (₱)] and, unless stated otherwise, include applicable taxes. Any delivery fees are shown before you confirm your order.
• Prices, promotions, and product availability may change at any time without notice.
• Products are subject to availability, and we may limit the quantity of any product available for purchase.
• Occasionally a product may be mispriced. If the correct price is higher than the price shown, we will contact you before dispatch to ask whether you wish to continue at the correct price or cancel, and we may cancel and refund the order if needed.

Available delivery methods, fees, and estimated delivery times are shown at checkout and may depend on your address and the products ordered.

• Delivery time frames are estimates, not guarantees. Delays can happen for reasons outside our control, such as carrier issues or weather.
• You are responsible for providing a complete, accurate delivery address and, where products are perishable or need a signature, for making sure someone is available to receive them.
• Responsibility for the products passes to you when they are delivered to the address you provided.
• We deliver only to locations within our serviceable areas. Where applicable, you are responsible for any local rules that affect receipt of your order.

Because many wellness and food products are perishable or sealed for safety and hygiene reasons, some items cannot be returned once delivered or once any seal is broken, except where the item is faulty, damaged, not as described, or where you have rights that cannot be excluded by law.

If something is wrong with your order

If an item arrives damaged, defective, incorrect, or past its usable date, please contact us within [return window, e.g. X days] of delivery with your order number and, where relevant, photos. We will arrange a replacement or refund as appropriate.

Changing or cancelling an order

If you need to change or cancel an order, contact us as soon as possible. We can usually only make changes before an order has been dispatched. After dispatch, the returns process above applies.

Refunds

Approved refunds are made to your original payment method within [refund processing time, e.g. X business days] after we receive the returned item or otherwise approve the refund. Your statutory consumer rights are not affected by this section.

All content on the Site — including the Flourish name and logo, text, graphics, product photography, page design, and software — is owned by Flourish or its licensors and is protected by intellectual property laws.

We grant you a limited, personal, non-transferable, revocable licence to view and use the Site for shopping and for managing your orders. You may not copy, reproduce, republish, distribute, sell, or create derivative works from any part of the Site without our prior written permission.

If you send us feedback or suggestions about the Site or our products, we may use them without any obligation to you.

If you submit content to the Site — such as reviews, ratings, comments, photos, or messages (“User Content”) — you keep ownership of it, but you grant us a non-exclusive, worldwide, royalty-free licence to use, store, display, reproduce, and adapt that content in connection with the Site and our marketing.

You confirm that your User Content:

• is yours to share, or you have permission to share it;
• is accurate and not misleading;
• is not unlawful, offensive, defamatory, or infringing of anyone else’s rights;
• does not contain confidential or sensitive personal information.

We may review, edit, decline to publish, or remove User Content at our discretion, and we are not obliged to publish anything you submit.

The Site and its content are provided on an “as is” and “as available” basis. To the extent permitted by law, we do not guarantee that the Site will always be available, uninterrupted, or error-free.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law.

Subject to the paragraph above, we are not liable for:

• indirect or consequential loss, or loss of profits, revenue, or data;
• loss or damage arising from misuse of a product, or from not following the instructions or label supplied with a product;
• events or circumstances outside our reasonable control.

Where we are found liable in connection with an order, our total liability is limited to the amount you paid for that order. Our products are not intended to diagnose, treat, cure, or prevent any disease. Your rights as a consumer that cannot be excluded by law are not affected.

We may update these Terms from time to time, for example to reflect changes to our products, the Site, or the law. The “Last updated” date at the top of this page shows when the most recent changes took effect.

Where changes are significant, we will try to make this clear. By continuing to use the Site after updated Terms are posted, you accept the updated Terms. We encourage you to review this page from time to time.

These Terms and any dispute arising from them are governed by the laws of Republic of the Philippines. Any disputes will be subject to the courts of the Republic of the Philippines.

This does not affect any mandatory consumer protection rights available to you under the laws of the country where you live.
